Rights
497: In the statutes, penalty for a Jew
having sex with a Christian prostitute who is not married, is not raped, and
is not adulterous is a monetary penalty left to the discretion of the judge.
Can a bishop have jurisdiction over a Jew for violating the Christian
prostitute? I think the bishop has no jurisdiction. A Jew is not under the
bishop's jurisdiction but under the secular prince (princeps).
498: The Princeps cannot expell Jews from
his territory. Jews are permitted to have their own law. Jews are part
of the "people" and part of the body of the city (corpus
civitatis). No Jew should be impeded from exercising his
rights. Jews who are living righteously should not be molested.
A Jew who attacks a cleric is subject to a monetary fine.
