Quid enim iustitia uult, idem et ius persequi studet. Accidit tamen ut quandoque . . . . ab ea <iustitia> dissonet <ius>. Quod cum fit iustitia ipsa siue equitas sic interpretatur ut siquid ius ab equitate aperte dissonet eius omissa auctoritate equitatem sequamur. (In effect justice and ius are the same or ought to be the same. It happens nevertheless that ius departs from justice. Because when it happens that justice or equity interprets ius differs from equity, we should follow equity since ius has lost its authority.) |
