Liber Sextus of Boniface VIII

Pope Innocent III 1203

In causis, quae summi Pontificis iudicio deciduntur, et ordo iuris et vigor aequitatis est subtiliter observandus, cum IN SIMILIBUS CASIBUS ceteri teneantur similiter iudicare, nisi forte, cum aliquid causa necessitatis et utilitatis inspecta dispensative duxerit statuendum (Cases in which the pope has rendered a decision, due process and rigor of equity must subtly be followed, since others are held to judge similarly in similar cases, unless the judge is led to render a decision otherwise for the reason of necessity or utility).
